Please read these Terms before creating an account. By downloading Marula or creating an account, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. About Marula
Marula is a language-learning dating application operated by Celony Inc. (d/b/a Marula), a Delaware corporation. Marula connects users who share language-learning goals and romantic or social interests and provides matching, real-time in-app translation, lessons, flashcards, and a phrasebook. These Terms govern the Marula app, getmarula.com, and related services for US users. We may update these Terms or introduce mandatory features that enhance functionality, security, safety, or user experience.
2. Automated Technology
Marula uses automated systems and AI for matching and translation. OpenAI receives message content solely when you choose to translate a specific message. Translation may lose nuance; clarify anything unexpected. You may enable or disable translation in app settings.
3. Eligibility
You must be at least 18, located in or resident of the United States, a real human individual, and not previously suspended or banned. You must not have committed, been convicted of, or pled no contest to a crime involving violence, a threat of violence, or sexual misconduct. You must agree to these Terms and the Privacy Policy, have only one account, and provide accurate information. We verify age using your date of birth.
4. Your Account
Create only one account, provide accurate information, protect your credentials, maintain a strong password, update your information, and contact contact@maruladating.com if you believe your account was accessed without permission. Your account is personal and may not be transferred, sold, or assigned.
5. Community Guidelines and Prohibited Conduct
Harassment, stalking, bullying, threats, non-consensual sexual content, discrimination, unwanted contact, child sexual exploitation, nudity, graphic violence, hateful or unlawful content, terrorism, trafficking, fraud, self-harm promotion, defamatory content, commercial solicitations, spam, malware, copyright infringement, impersonation, fake profiles, money solicitation, sex work, political campaign activity, multiple accounts, scraping, reverse engineering, bots, ban evasion, account sharing, and false reports are prohibited and may result in immediate suspension or permanent removal.
Content involving minors is reported to NCMEC and law enforcement. Do not post another person’s image, likeness, or personal information without consent. Do not use automated tools, crawlers, scrapers, malicious code, unauthorized APIs, or third-party applications that interact with Marula. Do not copy, distribute, alter, mirror, embed, or reverse engineer the Service or its branding.
5e. Copyright Reporting
Send DMCA notices to Hadley Mantia at contact@maruladating.com with the subject “DMCA Takedown Notice.” Include your legal name and contact information, a description and location of the copyrighted work, good-faith and accuracy statements, and your signature. Counter-notices may use the subject “DMCA Counter-Notice.”
6. Safety and In-Person Meetings
Marula is an introduction service. We do not conduct background checks or verify profiles and are not responsible for user conduct on or off the platform. For a first meeting, use a public place, tell a friend where you are going, protect personal and financial information, and trust your instincts. Use translation thoughtfully, clarify unclear messages, and learn key local safety phrases.
7. Content You Post
You own your photos, profile text, and messages. By posting, you grant Marula a limited, non-exclusive, royalty-free license to host, store, display, process, reproduce, adapt, distribute, and make your content available as needed to operate the Service. The license ends when you delete the content or account, subject to the Privacy Policy. You are responsible for what you post and must own it or have permission to share it. Do not post personal contact information or Prohibited Content. Your profile is visible to users who may share it outside Marula. We may review, remove, edit, limit, or block content at our discretion.
8. Content of Other Users
Other users own their photos, profiles, and messages. You may interact with that content only as intended to connect and communicate. You may not copy, download, screenshot, or use it outside the Service. We cannot verify that user content is accurate or genuine.
9. Moderation
Marula uses automated technology, human review, and user reports to enforce these Terms. Violations may result in warnings, temporary restrictions, or permanent removal. Child sexual exploitation and terrorist content result in immediate permanent bans. Appeals must be emailed to contact@maruladating.com within 30 days with the subject “Moderation Appeal,” your account email, what happened, and why the decision was incorrect. We respond within 30 days. Bad-faith reports and appeals may result in further enforcement.
10. Intellectual Property
The app, website, language modules, brand, logo, trademarks, software, design, and content created by Celony Inc. are protected by US and international law. You may not reproduce, distribute, modify, publicly display, perform, or reverse engineer the Service without written permission.
11. License to You
While you comply with these Terms, Marula grants you a personal, non-exclusive, non-transferable, revocable, worldwide, free license to use the Service for its intended personal purpose. The license ends immediately if you violate these Terms.
12. Rights You Grant Marula
You grant Marula a worldwide, royalty-free, non-exclusive license to host, store, display, reproduce, adapt, distribute, and otherwise make your content available as necessary to provide the Service. Feedback may be used without compensation. Marula may access, preserve, or disclose account information and content when reasonably necessary to comply with law, enforce these Terms, respond to claims or support requests, protect safety and property, or investigate fraud and misconduct.
13. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free service, a romantic match, compatibility, or accurate profiles. We are not responsible for user conduct.
14. Limitation of Liability
To the maximum extent permitted by law, Celony Inc. and its officers, directors, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages. Total liability is limited to the greater of the amount paid to us in the preceding 12 months or $100. Some states limit these exclusions.
15. Indemnification
You agree to defend, indemnify, and hold harmless Celony Inc. and its officers, directors, employees, and agents from claims, damages, losses, liabilities, costs, and legal fees arising from your use of the Service, violation of these Terms or third-party rights, or content you post.
16. Dispute Resolution
Contact contact@maruladating.com first and allow 30 days for informal resolution. If unresolved, disputes will be resolved by binding individual arbitration administered by the AAA under its Consumer Arbitration Rules, in English, in New York, New York, or by video conference. YOU AND MARULA WAIVE THE RIGHT TO A JURY TRIAL AND CLASS ACTION. Small claims and emergency equitable relief are exceptions. Delaware law governs these Terms; non-arbitrated claims belong in courts in New York County, New York.
17. Termination
You may delete your account through Settings → Account → Delete Account. Deletion is permanent. Marula may suspend or terminate accounts with or without notice for violations, harmful conduct, or any other reason at its discretion. Provisions concerning content, intellectual property, disclaimers, liability, indemnification, dispute resolution, and general terms survive termination.
18. General
These Terms and the Privacy Policy are the entire agreement. Unenforceable provisions will be modified to the minimum extent necessary. Failure to enforce a provision is not a waiver. You may not assign your rights without consent; Marula may assign its rights in a merger, acquisition, or asset sale. 19. Privacy and Sensitive Information
Your use of Marula is also governed by our Privacy Policy at getmarula.com/privacy. Sensitive information may include romantic and relationship preferences, sexual orientation if provided, gender, profile photos, private communications, and language preferences. It is used only for matching and language learning, not sold or shared with advertisers. We use HTTPS/TLS in transit, encryption at rest, technical access controls, and security testing. Sexual orientation is optional and may be removed through account settings. Contact contact@maruladating.com about access, correction, or deletion rights.
20. Acceptance
By downloading, accessing, or using Marula on iOS, Android, or the website, you agree to these Terms, the Privacy Policy, and the Community Guidelines. If you do not agree, do not use the Service.
